Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Automo mobile application or web platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Automo Tech, Bangladesh.

2. Description of Service

Automo is an IoT automation platform that enables users to:

• Control smart devices (relays, switches, motors) via MQTT protocol.
• Create automation schedules and sensor-based rules.
• Monitor camera feeds via RTSP streams.
• Manage organisations, zones, and multiple users with role-based access.

3. Account Registration

To use Automo, you must create an account or join an existing organisation via invite code. You agree to:

• Provide accurate and complete registration information.
• Keep your password secure and not share it with others.
• Notify us immediately of any unauthorised access to your account.
• Be responsible for all activity that occurs under your account.

Accounts are non-transferable. You may not create accounts for others without their consent.

4. Acceptable Use

You agree to use Automo only for lawful purposes. You must not:

• Use the Service to control devices in ways that could cause harm to persons or property.
• Attempt to gain unauthorised access to other users' organisations or devices.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Use the Service to transmit malware, viruses, or harmful code.
• Violate any applicable law or regulation in Bangladesh or internationally.
• Interfere with or disrupt the integrity or performance of the Service.

5. Electrical and Safety Responsibility

You acknowledge and agree that:

• All electrical installations must be performed by a qualified electrician.
• You are solely responsible for the safe installation and use of hardware connected to Automo.
• Automo Tech is not liable for any damage, injury, or loss resulting from improper hardware installation or use.
• You must comply with all applicable electrical safety standards and regulations in Bangladesh.
• You will not use Automo to control life-safety systems without appropriate redundant safety measures.

6. Camera and Surveillance

If you connect cameras to Automo, you agree to:

• Only connect cameras to locations where you have legal authority to surveil.
• Comply with all applicable laws regarding surveillance and recording in Bangladesh.
• Inform any persons present that they may be recorded, where legally required.
• Not use camera features for illegal surveillance, stalking, or harassment.

7. Organisation and User Management

Organisation Admins are responsible for:

• Managing member access and permissions appropriately.
• Ensuring members comply with these Terms.
• Revoking access for members who violate these Terms.

Automo Tech is not responsible for actions taken by organisation members within the platform.

8. Intellectual Property

The Automo application, including its design, code, trademarks, and content, is owned by Automo Tech and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for its intended purpose.

You retain ownership of your data (device configurations, automation rules, camera URLs) stored in the Service.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide advance notice where possible).
• Unexpected technical failures.
• Events beyond our reasonable control (force majeure).

We are not liable for any loss or damage caused by service unavailability.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Automo Tech shall not be liable for:

• Any indirect, incidental, special, or consequential damages.
• Loss of data, revenue, or business opportunities.
• Damage caused by hardware connected to the platform.
• Actions of third parties including other organisation members.

Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Termination

You may terminate your account at any time through the App Settings. We may suspend or terminate your account if you:

• Violate these Terms of Service.
• Engage in conduct that we reasonably believe could harm other users or the Service.
• Fail to pay applicable subscription fees (if any).

Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via the App or email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Bangladesh. Any disputes arising from these Terms shall be resolved in the courts of Bangladesh.
